01 Agreement to these terms

Welcome to JackGenerate. By creating an account, accessing, or using our AI photo and video generation platform, websites, and related services (together, the "Service"), you agree to be bound by these Terms & Conditions (the "Terms") and our Privacy Policy. If you do not agree, please do not use the Service.

We may publish additional guidelines, acceptable-use rules, or policies for specific features. Those are incorporated into these Terms by reference. If there is a conflict, the feature-specific policy controls for that feature.

02 Eligibility & your account

You must be at least 18 years old, or the age of majority in your jurisdiction, to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at the first sign of unauthorized use.

• Provide accurate, current, and complete information when you register.
• Maintain one account per person, unless you are authorized for team or multi-seat use.
• Keep your password secure and do not share your access with others.

03 Plans, tokens & billing

JackGenerate offers recurring subscription plans and one-time, pay-as-you-go token packs. Prices are shown on our Pricing page and are exclusive of any applicable taxes, which may be added at checkout.

Subscriptions

• Paid plans renew automatically at the end of each billing period (monthly or annual) until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis.
• You may cancel at any time from your account; cancellation takes effect at the end of the current billing period, and you retain access until then.
• Each plan includes a monthly allotment of tokens that resets at the start of each billing cycle and does not roll over.

Free trial

We may offer a 7-day free trial. Unless you cancel before the trial ends, your subscription will begin automatically and your payment method will be charged for the first billing period. You may cancel at any time during the trial without charge.

Tokens

Tokens are the credits consumed when you generate. Purchased token packs are a one-time purchase, do not expire, and stack on top of any plan. Tokens have no cash value, are not redeemable for money, and are non-transferable.

04 Acceptable use

JackGenerate is a powerful creative tool, and with that comes responsibility. You agree not to use the Service to create, upload, or distribute content, or to act in a way, that:

• Depicts a real, identifiable person without their consent, or impersonates someone in order to deceive, defraud, or mislead.
• Sexualizes minors or contains non-consensual intimate or sexually explicit imagery.
• Promotes violence, terrorism, self-harm, harassment, hatred, or discrimination, or facilitates illegal activity.
• Infringes the intellectual property, privacy, publicity, or other rights of any third party.
• Creates misleading "deepfakes", disinformation, or content presented as authentic that is intended to deceive the public.
• Attempts to reverse engineer, scrape, overload, circumvent usage limits, or interfere with the security or integrity of the Service.

05 Your content & ownership

Your inputs

You retain all rights you already hold in the prompts, reference images, and other materials you submit ("Inputs"). You represent that you have the rights necessary to submit your Inputs and that they do not violate these Terms or any law. You grant us a limited, worldwide, royalty-free licence to host, process, and transmit your Inputs solely to operate, secure, and improve the Service. We do not sell your Inputs.

Your outputs

Subject to your compliance with these Terms and applicable law, and to the extent we hold rights capable of being assigned, we assign to you the photos and videos you generate ("Outputs"). On every paid plan this includes a worldwide, royalty-free licence to use your Outputs for commercial purposes, with no watermark.

Because generative models can produce similar results for different users, we cannot guarantee that Outputs are unique, and we make no representation that your use of an Output will not infringe a third party's rights. You are responsible for reviewing and clearing your Outputs before use.

06 Our intellectual property

The Service — including its software, machine-learning models, user interface, design, text, and the "JackGenerate" name and logo — is owned by SMART SERVICE HUB LLC or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. No rights are granted to our branding, source code, or underlying technology except as expressly stated here.

07 AI outputs & disclaimers

The Service uses generative artificial intelligence. Outputs are produced automatically and may be inaccurate, unexpected, offensive, or resemble existing works or persons. Outputs do not represent the views of JackGenerate and should not be relied upon as factual, professional, legal, medical, or financial advice.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation, to the fullest extent permitted by law.

08 Third-party services

The Service relies on third-party providers — for example, payment processors, cloud hosting, and model providers — and may link to third-party websites. We are not responsible for the content, policies, or practices of third parties, and your use of their services is governed by their own terms.

09 Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or possible legal exposure for us, or for extended inactivity, and we will give notice where reasonably practicable. On termination, your right to use the Service ceases immediately. Provisions that by their nature should survive — including ownership, disclaimers, liability limits, and governing law — will survive.

10 Limitation of liability & indemnity

To the fullest extent permitted by law, JackGenerate and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or related to your use of the Service. Our total aggregate liability for any claim will not exceed the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or EUR 100.

You agree to indemnify and hold harmless SMART SERVICE HUB LLC from any claims, damages, and expenses (including reasonable legal fees) arising from your Inputs, your Outputs, your use of the Service, or your breach of these Terms. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your non-waivable statutory consumer rights.

11 Governing law & disputes

These Terms are governed by the laws of Georgia, without regard to its conflict-of-laws rules. Subject to any mandatory rights you have as a consumer to bring proceedings in your country of residence, the courts of Tbilisi, Georgia will have jurisdiction over any dispute arising out of or in connection with these Terms or the Service. We encourage you to contact us first so we can try to resolve any issue informally.

12 Changes & contact

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice before they take effect, and we will update the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
